Wrongful Death and Survival Claims are distinct, statutory based claims existing for the benefit of family members and the decedent's estate, respectively. These claims can result from a work-related accident, a motor vehicle accident, medical malpractice, or from any other catastrophic personal injury case causing death.
If your child, spouse or family member died as a result of someone's negligence, we will have a family member or an executor appointed to have the legal authority to obtain medical records and file suit. We will investigate the case thoroughly, obtain expert opinions to establish liability and to establish the economic damages sustained. At the conclusion of the case we will obtain court approval to settle and distribute the wrongful death proceeds to those entitled to share in the recovery and we will resolve any health care, state, federal, or employer liens.
